CONSTRUCTION DISPUTE EXPERT WITNESS
When the parties to a construction contact are unable to agree, litigation, arbitration or adjudication may be unavoidable. In this event, it is often necessary to have expert opinion in order to support or defend a claim. Dr Eaton is an experienced construction industry expert witness.
He regularly acts in the capacity of expert witness in construction disputes and has appeared on numerous occasions at court proceedings, construction arbitrations and construction adjudications. He is trained and experienced in the preparation of expert reports and is used to meeting with other experts to narrow the issues in dispute. His experience and training extends to giving evidence at court and at other tribunals.
The range of issues where Dr Eaton has been retained to give his opinions is considerable and the scope of his appointments have been both in support of or in the defence of claims. In the past fifteen years Dr Eaton has been appointed in a significant number of matters and acts regularly for both individual parties and insurers.
Construction disputes range across a very wide range and give rise to maters involving the conduct of chartered architects as well as construction contract disputes. Professional negligence, as well as questions of technical competence and copyright are all areas where the expert opinion of Dr Eaton has been given. Underpinning this advice is the overriding objective of the expert which is to give clear, balanced, fair, and impartial opinions. Dr Eaton is fully aware that his primary obligation is to be objective. This is the overriding objective of any court action and, notwithstanding this, it is the primary objective of any opinion he is asked to give.
